N/B: You should generally avoid generic answers like “Oh, I do IT work or I’m a software developer doing something in software. The visa officer wants to know what you really specify in and what particular role is needed in this company.  

  1. Question: Where will you be working? 

Response: I’ll be working at my employer’s primary office in Austin, Texas. The address is listed on the LCA and the I-129 form as well.

Meanwhile, if you’re working on a client’s site you could say; 

I will be working on the client site, which is at J.P. Morgan Chase, but my payroll will be run by TCS, which is my original employer. All of my projects and supervision details are already listed down on the LCA.

  1. Question: How did you find this job and when did you join this company? 

Response: Well, you know, right after my graduation at USC, there were some campus job fairs. I met this employer there and I started working with them on my OPT, after which they sponsored me for the H-1B. 

  1. Question: What is your salary? 

Response: Officer, my annual salary is $105,000. This is exactly what’s stated in my LCA and job offer as well. And I get paid bi-weekly via direct deposit. 

N/B: Please know that salary must match or exceed the prevailing wage on the LCA. 

  1. Question: What are your qualifications? 

Response: Well, officer, as I mentioned, I graduated from USC. I pursued my master’s in computer science over there and I finished in 2022.

N/B: Please don’t extend this answer too long. Just mention your highest qualification. 

  1. Question: Have you ever been out of status in the United States? 

Response: No, officer. I’ve always been on legal status. I remember after my graduation, I went on to the F1 OPT, did some STEM OPT as well after that, and then got the H-1B lottery picked up. So yeah, I’ve always been in status.

  1. Question: Are you married? And if yes, is your spouse applying with you? 

Response: Yes, officer. I’m married. My spouse is applying with me for the H-4. 

  1. Question: Do you have any dependents in the United States? 

Response: Yes, officer. I have one spouse in the U.S. and also a kid who’s three years old. 

  1. Question: Have you ever been refused a U.S. visa before? 

Response: Yes, officer. Once in 2019. I feel like since it was my first interview, I was not well prepared and I just stumbled, and couldn’t really get my point through to the officer. And because of that, I might have faced a rejection.

N/B: Always make sure to disclose rejections if you’ve had any. They have it anyway in their system.

  1. Question: What are your long-term plans in the United States? 

Response: Well, officer, as of today, I wish to continue working with my employer. I don’t see myself leaving the Deloitte team for the longest time. But if my employer sponsors me for the green card, I would potentially stay back in the U.S. 

N/B: For this one, you don’t want to go ahead and say it out loud that “I want to settle down in the U.S. permanently”. But if asked, you can say that indirectly like the sample response above.  

  1. Question: What is your current immigration status? 

Response: Officer, I’m currently on STEM OPD, transitioning into the H-1B. 

Or you could say; 

Officer, I’m here for renewal. I’ve already been on the H-1B for the last three years. And that’s it!
